E-Sign Consent Agreement

Zero Technologies, LLC and its affiliates and service providers (collectively, “Strictly,” “we,” or “us”) may need to provide you with certain communications, notices, disclosures, agreements, statements, and other information (“Communications”) in connection with your use of our services, website, or merchant application process (collectively, the “Services”).

This Electronic Signature Consent Agreement (“Consent”) explains your rights regarding receipt of electronic Communications and the use of electronic signatures.

By proceeding with this application and checking the box provided, you acknowledge and agree to this Consent, our Terms of Use, and our Privacy Policy. If you do not agree, you may not complete the application or use the Services.

1. Scope of Consent

By accepting this Consent, you agree that:

  • We may provide all Communications electronically via email, SMS/text message, secure portal, or through our website.
  • Your electronic signature has the same legal effect as a handwritten signature.
  • This Consent applies to all Communications, including:
  • The Merchant Processing Agreement and related disclosures, schedules, and amendments.
  • Our Terms of Use and Privacy Policy.
  • Personal guaranties, if applicable.
  • Payment authorizations, receipts, and transaction confirmations.
  • Statements, notices, and tax-related documents required by federal or state law.

You acknowledge that the Merchant Agreement you are signing is between you and Elavon, Inc. and U.S. Bank N.A., and that Zero Technologies, LLC is acting as an authorized agent of Prospay Inc., an Independent Sales Organization of U.S. Bank N.A. After signup, a paper copy of the fully executed Merchant Agreement will be emailed to you by Elavon for your records.

2. System Requirements

To access and retain electronic Communications, you must have:

  • A computer or mobile device with internet access.
  • For web access: a modern web browser with 256-bit encryption; cookies enabled (note that browser extensions may interfere); and Chrome, Firefox, or Safari in its latest version.
  • For mobile access: a device that supports apps from the Apple App Store or Google Play and the most current version of iOS or Android.
  • Access to the email address used in your application.
  • Adequate storage or the ability to print documents.
  • A functioning spam filter that allows messages from [insert email domain].

3. Right to Paper Copies

You may request a paper copy of any Communication free of charge within 180 days of its issuance by sending a written request to:

Requesting a paper copy does not withdraw your consent to electronic Communications unless expressly stated.

4. Withdrawal of Consent

You may withdraw your consent to receive electronic Communications at any time by notifying us in writing at the contact information above. If you withdraw:

  • Your access to the Services or application process may be suspended or terminated.
  • The withdrawal will be effective after we process your request.
  • We will confirm the effective date of withdrawal in writing (electronically or by mail).

5. Updating Your Contact Information

It is your responsibility to keep your contact information current. You may update your email or mailing address by contacting us at the email address above or through your online account (if available).

6. Acknowledgment and Agreement

By checking the box on the signup page, you confirm that:

  • You agree to this E-Sign Consent Agreement.
  • You consent to receive and sign all Communications electronically.
  • You have reviewed and accept the Terms of Use and Privacy Policy.
  • You are able to access, view, and retain electronic records as described above.
